Meghan Markle has scored a legal victory against her sister Samantha Markle after a judge dismissed defamation lawsuit against her.
Florida Judge Charlene Edwards Honeywell reportedly dismissed the lawsuit against the Duchess of Sussex because the comments she made during her Oprah interview and in her Netflix series were ‘substantially true.’
Samantha also ‘failed to identify any statements that could support a defamation claim.
Meghan’s sister won’t be able to refile the case as it was dismissed with prejudice.
According to reports, Samantha was seeking at least $75,000 for defamation as Meghan said that she grew up as an only child.
The duchess also claimed that her sister only changed her surname back to Markle after she started dating Prince Harry.
In the ruling, the judge said that the duchess’ remarks could not be defamatory as they are ‘substantially true based on judicially noticed evidence’ or ‘not capable of being considered defamatory.’
Judge Honeywell also said that Samantha failed to ‘plausibly allege that they are defamatory in the first place.’
Regarding Meghan’s statement that her sister changed her name from Rasmussen back to Markle after she started dating Harry, the judge said that ‘the gist was true.’
“’That Plaintiff used one last name and then the name Markle soon after reports of Defendant’s relationship with Prince Harry were published is substantially true, based on the exhibits in the record, of which the Court has taken judicial notice,” the judge added.
