35-year-old Lee Hogben has been jailed for 12 years after he removed his condom during sex with a prostitute.
He ignored the woman’s repeated objections and continued having unprotected sex with her in a 4-star Royal Bath Hotel in Dorset.
Hogben broke the agreed terms of consent with the woman, aged in her 20s, who immediately reported the incident to the police.
The 35-year-old was arrested on suspicion of rape and forensic tests taken from the escort matched his DNA to a probability of 1 in a billion.
He initially denied the charge of rape but was eventually found guilty after a trial.
Hogben even threatened to kill the complainant’s grandparents when she complained. He wrote in a message: “I’m going to have your head smashed in for what you’ve done to me and I’m gonna kill your grandparents.”
He also threatened to shoot the sentencing judge after being imprisoned for 12 years. He told judge Stephen Climie: “I’m coming for you. You’ll get a shotgun in the face at night.”
The court heard the woman advertised her services on a website. She indicated online that all her clients must use protection. Hogben contacted her and the two met at the hotel. They also agreed on a price for two hours of her services.
Jodie Mittell, prosecuting, said: “Hogben went beyond what was consented to by removing the protection, which the complainant will say was a condition of intercourse.
“She repeatedly protested, ‘I don’t do that – please, no’. She tried to wriggle away but he told her to stop. He told her he had beaten people up and robbed people.”
He also left without paying the woman despite spending two hours with her in the hotel.
Hogden was convicted of rape and two counts of assault in relation to the victim. He pleaded guilty to threatening to disclose private photographs, destroy property, making a malicious communication in relation to another victim, and breaching a restraining order.
