A US District judge has rejected R.
Kelly’s third request that he be released from prison early. The R&B singer has argued that he is vulnerable to testing positive for Covid-19 because he is prediabetic.
However, Judge Ann Donnelly said that she does not believe that prediabetes is big enough of a symptom to grant the singer an early release. While she admitted that the CDC did cite diabetes as increasing the risks for the virus, Judge Donnelly said that one-third of Americans are prediabetic.
Moreover, Donnelly added that a regular lifestyle and exercise at prison will actually help Kelly maintain a healthier physical condition. The judge said that prison doctors have told her how they were working with the disgraced musician to better his health under incarceration.
Kelly has been in prison since July of last year as he awaits trial. He has been accused of sexually assaulting four different women who were either minors or very young.
Moreover, the Daily Mail reports that the singer is facing “several dozen counts” on state and federal levels over his sexual misconduct. Not only has Kelly been accused of sexually assault, but he has also allegedly recruited girls and racketeered them using his fame.
Judge Donnelly’s decision comes after Kelly’s defense attorney filed a motion to release the singer by citing horrible conditions in the prisons as the reason. Michael Leonard, Kelly’s lawyer, alleged that the conditions of incarcerations have worsened after the outbreak of the virus.
Writing to the judge, Leonard argued that he heard inmates begging for help while the prison authorities only focus on strengthening their grips on the prisoners. He also argued locking healthy inmates with those who may be positive is a big risk and danger.
Leonard went on to cite federal records that showed how more than 500 inmates have been infected with the novel coronavirus, and said that his client will almost certainly be infected as well if he isn’t released.
The attorney said that Kelly should be allowed to stay in Chicago with his girlfriend. Leonard argued that the risk of Kelly escaping would be extremely low as he will be under surveillance by both authorities and the public.
