As Covid-19 continues to rage throughout the globe and especially in the United States, the economic damages of the global pandemic are becoming clearer.
Cinemas have especially suffered from the virus since it has been closed since the early stages of the pandemic.
For the first time since the movie houses were forced to close as per government orders, some of the largest cinemas have decided to take legal action against the state of New Jersey.
According to the Hollywood Reporter, AMC, Cinemark and Regal are were among the cinemas that decided to take action. The logic that the cinemas are putting forth is that there is no reason why cinemas should be single out as the one industry that is not allowed to reopen its doors.
By arguing that there is no legal or constitutional basis to distinguish a cinema from other public places, such as churches, the representatives for the cinemas have called for New Jersey governor Philip Murphy to allow them to resume business.
As of now, the state of New Jersey is currently in its Stage 2 of reopening the state. This means that less congregated public spaces, such as retail stores and indoor malls, have been allowed to resume business. Religious facilities such as churches have also been allowed to open its doors.
The legal team for the cinemas pointed out that conspicuously lacking from this gradual reopening process was any indication of when Stage 3 of the reopening will take place – at which point the cinemas will be allowed to reopen legally.
One of the reasons that the cinemas decided to target New Jersey in particular is because the state is doing much better than the other states in which the spread of Covid-19 has worsened since its reopening.
The case is likely to attract much attention from other industries that have been forced to close down because of the government orders pertaining to Covid-19.
Because the legal defense team is citing the violation of the First Amendment, if the cinema owners win the case, it can very likely to be applied to all other industries.
