In one of the most historic moments for LGBTQ rights in the United States history, Donald Trump’s appointee to the Supreme Court Justice Neil Gorsuch has officially sponsored and delivered his judgment on Monday, ensuring the 7 million LGBTQ individuals get a guarantee by law in living and working in the US.
It is a setback for the administration which has blatantly been anti-LGBTQ in its policies and cutbacks.
Indeed, it is a remarkable change of opinion, and a major movement for the justice, as he not only is leaning for the decision, but ultimately became the writer of the opinion, representing all those for protecting the gay, lesbian and transgender workers.
They will now be protected by federal law in getting equal representation and equal treatment with heterosexual individuals.
Those in the conservative agenda are flabbergasted, as they have been betrayed by their one from their side. Considering the lengths the conservatives went through to appoint Gorsuch in the midst of the hubbub of the initiation of Trump’s settling in the White House.The ruling will now put him as the main sponsor and deal-breaker for working rights.
Title VII of the Civil Rights Act, Gorsuch wrote, which bars discrimination “because of sex,” also covers claims based on sexual orientation and gender identity.
Gorsuch is now being reviewed by peers and legal analysts to be the most fundamental interpreter of the legal texts, in what would be referred correctly to as “rules of statutory interpretation”, which was undoubtedly an analytical legacy stemming down from the late Justice Antonin Scalia, respected regardless of his political preferences.
Although Gorsuch has many times acted in a way that Trump would be defended, this time not being that case.
This has proven that Gorsuch may not be the hawkish defender of the conservative side, but rather be a staunch fundamentalist when it comes to protecting the legal basis of the United States.Joining Gorsuch were Chief Justice John Roberts, and the four liberals on the bench, Justices Ruth Bader Ginsburg, Elena Kagan, Sonia Sotomayor and Stephen Breyer. The justices have let Gorsuch on his own to present the announcement solely under his name.
As for Gorsuch, he once rejected talk of “hard right turns” on the bench during a news interview. “I just don’t view judges that way, I reject that idea of how judges operate,” he said. He pointed out that about 40% of the courts cases are unanimous. “You have nine very independent people approaching these cases as best they can,” Gorusch said.
