S. government over a ban on its products.

The world’s biggest maker of telecommunications equipment, Huawei said that it has filed a lawsuit challenging the U.S. law that bans federal agencies from purchasing and using its products.

“This ban not only is unlawful, but also restricts Huawei from engaging in fair competition, ultimately harming US consumers,” said Huawei Deputy Chairman Guo Ping at a news conference at their headquarters in Shenzhen.

He also accused Congress of acting as ‘judge, jury and executioner’.

Huawei, also a top smartphone maker, is asking to overturn part of the National Defense Authorization Act, which was signed by President Trump.

The Chinese company alleges that a part of the law, which forbids agencies from buying the technology and its rival ZTE, violates the U.S. Constitution by singling out a group or individual for punishment without trial.

Guo said: “The US Congress has repeatedly failed to produce any evidence to support its restrictions on Huawei products. We are compelled to take this legal action as a proper and last resort.”

Huawei’s smartphones compete globally with those of Samsung and Apple. However, Washington has been suspicious that the Chinese government could use Huawei products to spy other countries, without giving specific evidence.

Huawei’s lawsuit could force the U.S. government to show a public case against the company as it ramps up its pressure to the campaign.

The U.S. government urges allies to restrict or ban Huawei products from 5G networks, citing concerns over spying but without clear evidence. The issue complicated the Chinese company’s plans for growth and triggered complaints from wireless carriers that the U.S. campaign interrupts their plans.

Paul Triolo, an expert on global tech issues, said: “Huawei is showing that it will not roll over on the US full court press.

“It is not likely to result in Huawei gaining new access to the US market. But it is a symbolic marker that could influence other players around the world considering potential limitations or bans against the firm,” he added.
