Missouri’s 8-Week Abortion Ban Blocked By A Judge A Day Before It Was Going To Take Effect


A federal judge blocked Missouri from enforcing a ban on abortions post 8 weeks of pregnancy on Tuesday.

The ban is set to take effect from Wednesday. This comes after several state courts knocked down early-term abortion bans.

Howard Sachs, the U.S. district judge, wrote that Missouri’s attempt to ban abortions for pregnancies that are nonviable was clearly opposed to the U.S. Supreme Court order.

He mentioned that while federal courts should be very cautious before delaying the effect Law of Sate, the sense of caution may be protected when the legislations appear designed, as here, a revolt against Supreme Court decisions.

The judge ruled out that Missouri could go ahead with a ban on aborting pregnancies based on race, gender, or Down Syndrome diagnosis. He also noted that he hoped that law would gradually be struck down as unlawful.

Still, he did not accept a request by St. Louis’ Planned Parenthood for a preliminary order because it had not presented adequate evidence that females would be affected by that law as the case proceeded.

The CEO and acting president of Planned Parenthood Federation of America, Alexis McGill Johnson, stated that they would go on to press their challenge to reason-based abortion ban.

Johnson added that such severe limitation on abortion access does nothing to address discrimination or disability rights.

Planned Parenthood clinic at St. Louis is the only clinic providing abortion in Missouri. Earlier in 2019, the state disagreed to renew its license and threatening the clinic to operate.

However, a judge, and post that a state administrative commission granted the clinic permission to stay open while it is challenging the licensing decision.

Judges in Kentucky, Mississippi, Ohio, Iowa, and North Dakota have blocked laws that prohibit abortions after 6 weeks of pregnancy.
