Amber Heard has once again demanded a retrial after allegedly discovering that one of the jurors was an impersonator.
On Friday, the actress’s legal team filed court documents asking for a retrial “based on additional discovered facts.”
As Heard’s attorneys claimed, one of the jurors who sided with Johnny Depp and contributed to reaching the verdict in Depp’s favor was an impersonator of the juror that was supposed to sit the trial.
According to the complaint, the jury duty summons was sent to a Virginia property where two people with the same surname lived. The lawyers argue that a 52-year-old juror appeared in court even though the summon was meant for a 77-year-old juror with the same last name.
“It is deeply troubling for an individual not summoned for jury duty nonetheless to appear for jury duty and serve on a jury, especially in a case such as this,” they said.
Heard’s team further argued that safeguards put in place to avoid such mistakes were “circumvented or not followed.”
“Those safeguards are in place and relied upon by the parties to verify the identity of the correct juror, to ensure due process and a fair trial for all litigants,” the filing adds.
“When these safeguards are circumvented or not followed, as appears to be the case here, the right to a jury trial and due process are undermined and compromised.
“Under these circumstances, a mistrial should be declared, and a new trial ordered.”
Despite the bombshell allegations, the lawyers seemingly didn’t provide any information on how the alleged truth about one of the jurors was uncovered.
The filing comes just days after the actress called for a retrial saying the verdict was “not supported by evidence.”
