A worker has initiated a legal battle against his boss, ‘Mr.
Stinky,’ who allegedly bullied him when the man was in his office.
56-year-old David Hingst from Melbourne demanded a $1.8 million payout in a suit against Construction Engineering last year.
After a Supreme Court judge decided that there was no bullying at the man’s workplace, Hingst decided to take his case to the Court of Appeal.
According to the 56-year-old engineer, his ex-boss, Greg Short, bullied him by thrusting his bum against him and farting. As David claims, Short was a serial farter who intentionally entered his small office with no windows up to six times a day and farted before leaving.
“I would be sitting with my face to the wall and he would come into the room, which was small and had no windows,” David said in an interview with AAP after the hearing at the Court of Appeal.
“He would fart behind me and walk away. He would do this five or six times a day.”
As the structural engineer added during the hearing, his boss “thrust his bum at me while he’s at work.” David also alleged that “Mr. Stinky” would taunt him with gestures and bully him over the phone.
While Justice Phillip Priest said that the farts were not the key issue in this case, Mr. Hingst said they should be taken into the account because they caused him great distress.
According to the 56-year-old engineer, the bullying left him with severe “psychiatric injuries.” The man is now working on his appeal because he believes that the trial and Supreme Court Justice Rita Zammit were biased against him.
As Justice Priest expressed, however, the trial judge has shown“remarkable latitude” against Mr. Hingst. “The very distinct impression I get is you were given every opportunity to put your case,” he added. The case continues.
